UpSwing Canine Behavioral Services - Fetch & Fable

Master Service Agreement

This Agreement is entered into by and between UpSwing Canine Behavioral Services (“UpSwing,” “we,” “our,” or “us”) and the undersigned client (“Client,” “you,” or “your”). *UpSwing Canine Behavioral Services and Fetch & Fable are DBAs of UpSwing Total Pet Care LLC.” By signing below, you agree to the following terms and conditions:

1. Services

UpSwing provides canine behavior consultations, learning programs, enrichment, lodging, and related services. Services will be scheduled as agreed and delivered in person, virtually, or at designated facilities.

2. Payment

  • All services must be paid in full at time of booking unless otherwise arranged in writing.

  • Multi-session packages must be used within 6 months of purchase unless otherwise agreed.

  • All payments are final, non-refundable, and non-creditable. At UpSwing’s sole discretion, alternate options may be discussed in exceptional circumstances.

3. Cancellations & Rescheduling

  • Sessions: At least 48 hours’ notice is required to cancel or reschedule. Late cancellations and no-shows are forfeited without rescheduling.

  • Lodging/Programs: Cancellations must be made at least 7 days in advance to request rescheduling.

  • All sessions must be completed within 6 months of the date of this Agreement. Any sessions not completed within that time will be forfeited.

4. Client Responsibilities

  • You agree to provide full and accurate information regarding your dog’s health, history, and behavior.

  • Dogs must be current on required vaccinations (Rabies, Distemper/Parvo, Bordetella), free of external parasites, and have a negative fecal test within the last 12 months.

  • You must disclose any history of aggression or bite incidents.

You remain legally responsible for your dog’s behavior at all times, whether on or off our property.


5. Client Code of Conduct

UpSwing is dedicated to creating a safe, supportive environment for all people and dogs. Aggressive behavior, bullying, harassment, intimidation, or discrimination will not be tolerated and may result in immediate termination of services. UpSwing reserves the right to terminate services immediately without refund if Client engages in such behavior.

6. Health & Safety

  • UpSwing reserves the right to refuse or discontinue services if a dog poses a safety risk or shows signs of contagious illness.

  • In case of illness or injury, we will attempt to contact you immediately. If you cannot be reached, we are authorized to seek veterinary care at your expense.

  • Client acknowledges that dogs may be exposed to varied conditions including, but not limited to, vehicular travel, interaction with people and other animals, exposure to adverse weather, and exposure to public or crowded spaces.

7. Learning Limitations

  • Consultant will make every reasonable effort to help Client achieve goals, but makes no guarantees of performance or outcome.

  • Behavior is not static; even well-learned behaviors require ongoing practice.

  • Especially in cases involving aggression, behaviors may be modified but dogs are never considered “cured.”

  • Responsibility for the dog’s ongoing behavior rests solely with the Client.

8. Assumption of Risk & Liability Waiver

  • Client acknowledges that canine learning, behavior modification, and lodging may involve risks, including injury to persons, dogs, or property.

  • Client accepts full financial and moral responsibility for the actions of their dog(s).

  • Client, on behalf of themselves, their heirs, assignees, and legal representatives, agrees not to make claim against, sue, or attach the property of UpSwing, its employees, contractors, representatives, or agents (“its Agents”), for injury or damage caused to or by the dog(s).

  • Client forever releases UpSwing and its Agents from all liability and demands arising from participation in services, except in cases of gross negligence.

Client agrees to indemnify and defend UpSwing against any claims or expenses resulting from their dog’s actions. 9. Communication

By signing this Agreement, you consent to receive service-related text messages from UpSwing. Message and data rates may apply. Reply STOP to opt out or HELP for assistance.

10. Media Release

Unless otherwise requested in writing, you grant permission for photos or videos of your dog to be used in educational, marketing, or promotional materials without compensation.

11. Privacy & Confidentiality

Your personal information will remain confidential. UpSwing may share relevant information with veterinarians, referral partners, or professionals directly involved in your dog’s care.

12. Dispute Resolution

Client and Consultant agree to mediate and/or arbitrate any misunderstanding or dispute arising from this Agreement. In any action or proceeding, the prevailing party shall be entitled to reimbursement of reasonable legal fees and costs.

13. Governing Law

This Agreement shall be governed by the laws of the Commonwealth of Pennsylvania.

Entire Agreement

This Agreement supersedes all prior agreements, written or oral, between Client and Consultant regarding the services described herein.
